The fact that Maureen Martinez was pregnant came to light after she was swept into City Creek and killed and an autopsy was performed. The suit alleged that the defendants were negligent when Base Line Road's crossing over City Creek was reopened to the public after it had flooded the day of her death. Maureen Martinez was caught in the January 10, 2005 deluge that pushed her car into the creek and swallowed it before the 8-foot-high waters ripped her from a fence she was clutching and down the creek to her death. In a settlement reached, a composite $775,000 was awarded to Daniel Martinez, Highland paid $357,500, the county paid $357,500, the East Valley Water District and developer Standard Pacific Homes paid $25,000 and developer Rancho San Andreas/National Equity Engineering paid $10,000.
